Is Palmetto Harmony legal? Linked below are key legislation pieces and a ninth circuit court case that was ruled on in 2004. The court case proves that hemp and any naturally occurring derivative of hemp THC or CBD is NOT a schedule 1 drug. It is also not a part of the Controlled Substance Act. (CSA). Therefore, making Palmetto Harmony legal.  Also attached is the DEA’s “list of controlled substances” that was published on January 11th, 2016.This list shows that neither Hemp nor CBD is listed as part of a controlled substance.

Federal Farm Bill

The first key legislation: The Federal Farm Bill allowed the first hemp to be grown in the U.S. which was passed in 2014. CBD strains were finally able to be cultivated as hemp. Therefore 20:1 strains or higher are all HEMP. These strains are non psychoactive and have minimal THC. Hemp is defined by the amount of THC NOT by the amount of CBD.

First State to Implement a Hemp Program

Second: Kentucky enacted the first hemp program. Hemp has always been legal in the U.S. which is why you can buy it in whole foods markets across the country. It is legal in all 50 states, so no matter where you are in the U.S you have access. Although Hemp wasn’t legal to be grown here until the 2014 Federal Farm Bill, which the DEA tried to shut down. The Agriculture department of Kentucky then sued the DEA which allowed the department of agricultural to license farmers. This lead to the first pilot research hemp program being enacted.

Yes, we were able to grow hemp, but we were given little to no information on the subject. We were unsure whether our hemp was allowed to be treated as overseas hemp and marketed sold. Most knew this had the ability to become a courts rights issue. Although no court would rule that overseas hemp was allowed rights that American hemp wasn’t.

Court Law

Finally! You have made it to the court law! When it comes to hemp, this is one of the most important court cases ever! In 2001 the DEA tried to halt all sales of hemp products in the U.S. Dr. Bonners sued the DEA. Not only did Dr. Bonner win, but the Ninth District Circuit Court ordered the DEA to pay Dr. Bonners legal fees. The court also ruled and clearly stated that hemp or any derivative of such hemp is NOT a Schedule 1 drug or part of the CSA.

Now if you look at the most current and defining moment in U.S. Grown hemp history you will find this. Mitch McConnell, the federal senator from Kentucky concreted hemp sales and distribution. McConnell did this by removing any funds from the federal government in the appropriations act. We should all thank McConnell for helping to pave the way for those of us who use Palmetto Harmony. Here is the key legislation that was just passed that takes any courts right issue or grey area away for American grown hemp compliant with section 7606.

    my grand son got cancer when he was 2 and now he’s 9 and having a hard time concentrating in school they have him on medicine and it’s not working and I have talked to parents and they said palmetto harmony has helped their kids and also he is a survivor for 5 years and he has all/adht and he keeps falling behind in school what I would like to know is it legal to give to him and what dose should I start out with thank you

    Husband is a disabled veteran with severe and constant neurological pain, to the point if he does not take his scheduled medications he has seizures. Also has extreme PTSD and migraines. If he has a US, is it possible for THC to pop positive. Granted knowing when he has appointments he wouldn’t take it within 24 hours anyways, but still. Not sure how VA works with results of that nature. Currently taking over 20 pills a day, half of which are no longer working at all to help him function daily in a decent quality of life. Do you think the oils may be beneficial? I see your company is for children…
